The old music industry model relied on the principal that distribution was hard. It's not hard any longer so the bottom has fallen out of their industry and the entrenched interests are afraid. You can't criminalize everyone. Attempts to do so have further hurt the industry instead of saving it.
So they have to sell somethign other then the distribution, like the performance, the packaging, the conveniences or the quality.
IP laws and Copyright have taken a twist for the worst. The original idea was that inventors and creators put their materials out into the public domain with a temporary monopoly on distribution and use to profit. Putting it out publically helps prevent ideas from being lost in time but this temporary monopoly has been stretched and abused past the original concept and most of the benefits are diminishing due to active attempts to stop cataloging for posterity (a lot of publishers are giving libraries a hard time.) - MiddleOfNowhere, on 06/18/2008, -0/+2Uhm, you haven't been paying attention.

You could download it and then pay as much as you wanted. The software world knows this concept as shareware.

If money isn't an issue, you are able to just concentrate on music when you are feeling inspired and happy with the results - that's what radiohead did by releasing stuff like Kid A which was completely polarising and experimental instead of releasing another version of the ok computer or the bends.
Kiss were always in it for the money and their music sounds like it - the same song 500 times.
