I don't think that it would hold up in court, even if the link had a full description as to what the content was; plenty of people click on links accidentally, and even more people click on any link sent to them.
Most people don't assume that they'll be directed towards inappropriate websites. That's why sites like goatse, lemonparty, tubgirl, and all of the other hundreds of shock sites out there are so popular. Granted their are appeals but that i little comfort to those who have been arrested or will be next.
