BitTorrent Tracker Hosting Illegal Says Dutch Court
torrentfreak.com — Leaseweb, the former ISP of BitTorrent trackers such as Demonoid, What.cd and Waffles.fm lost the appeal against the Dutch anti-piracy outfit BREIN. The Amsterdam court concluded that Leaseweb has to permanently shut down the BitTorrent tracker everlasting.nu, and hand over the admin’s personal information.

- sega01, on 07/04/2008, -2/+18More stupidity in court. To be frank, I'm not sure who is winning; the sharerers of multimedia, or the lawyers of copyright. Many artists are turning to creative commons licenses and even encouraging file sharing, but so many groups are winning in court against sites which are equivalent to Google, just with an easier and more fine-tuned interface.
- mrsteveman1, on 07/05/2008, -0/+1Google doesn't really provide backend support for a P2P protocol like some torrent sites do, but the search stuff is similar.
Of course, merely operating a backend for P2P technology is not and should not be illegal, at BEST it should be subject to the same DMCA takedown notices everyone else has to put up with.- mutz, on 07/05/2008, -0/+5DMCA is only in the usa... NOT in the rest of the world so ***** em...

- Sendai129, on 07/05/2008, -2/+22"Leaseweb’s defense argued that Everlasting was not facilitating copyright infringement, because the torrent files itself are not copyrighted. However, the judge ruled that this was irrelevant, since the files are an essential part of the download process. "
So what they are letting people download is not copyrighted....but somehow still illegal? They should go after gun stores next, because after all, guns are an essential part of murder (with a gun). Or better yet, prosecute anyone who sells steak knives as those are an essential part of the stabbing other people in the head process.- CatsAreGods, on 07/05/2008, -0/+5They already go after gun stores...
- twiztidsinz, on 07/05/2008, -1/+2The court said the .torrent file isnt copyrighted, but the material you obtain from the .torrent file is, so they are at fault.
- PopcornDave, on 07/05/2008, -1/+6No, by that reasoning they should go after anyone publishing a phone directory because that could be used in the commission of a crime being that they list names and addresses.
- cliffski, on 07/05/2008, -1/+1you need both a gun and ammo to shoot someone. If you supply ammo to a known hitman, you dont think you are guilty?

- dacodanelson, on 07/05/2008, -2/+9Wow, did they forget to mention that there's a ton of legal things on bit torrent trackers. That's where I'm releasing the video game I'm developing, and where I'm going to release my first album. I've seen a ton of legal things offered over torrents, just because they're the best way for individuals to launch information with bandwidth in mind.
Power to the sharing community. We'll find somewhere. And what ever happened to the pirate bay's island? I know it fell through, but they better get back on it.- cliffski, on 07/08/2008, -0/+1HAHAHAHAHAHA
they spent that money of yours for the island on hookers and alcohol. you really are thick enough to think that the right wing criminals who actually run thepiratebay behind the headlines were going to take donations for an island.
HAHAHAHAHAHA
hope dumb ***** like you contributed.

- grungemusic3001, on 07/05/2008, -0/+3If the admins of sites would use fake details it really would be better for everyone. Services like WebMoney will allow you to exchange money is virtually untraceable ways. Its commons sense really. (This is all hypothetical of course)
- OneStepAhead, on 07/05/2008, -0/+1im guessing when they turn over the name/address of these admins its going to lead them nowhere.... at least if it was my site it wouldn't!
