consumerist.com — Viacom is sending bogus copyright ownership claims and illegal posting notices to independent filmmakers posting their own movies on YouTube. These films contain not one iota of Viacom content. Take, for instance, this lovely short animation, "Juxtaposer," made by Joanna Davidovich for her senior project. It's completely her original creation.

- Midtowner, on 07/23/2008, -0/+2It's time we apply the English Rule to copyright cease and desist claims, i.e., if a court adjudicates that you sent out a claim in bad faith, or one which was frivolous, you or your corporation ought to be responsible for the defendant's attorney's fees.
Set up an administrative court to decide these things so as to not place too substantial a burden on the federal courts, but dammit, this crap has to stop. Major copyright holders have created a cottage industry for certain IP law firms to terrorize people on the internet. This sort of stuff is harmful to the free exchange of ideas and must be stopped.
Congress should step in and balance the needs of copyright holders to protect their property with the rights of people to communicate freely and partake of First Amendment protections such as fair use without the fear of bad faith and frivolous interference of copyright holders (or their agents). - Suneet67, on 07/23/2008, -0/+2Maybe it is time to actually start reading the "terms of service/conditions" contracts...
