- Stevanoski, on 07/04/2008, -0/+10Another win for the good guys, Judge Sweat denied Smith's request for attorney fees, but granted Marshall's, which asserted that Smith's fee motion lacked substantial justification and was interposed for delay or harassment, and that Smith's questions in both depositions were deliberate and willful attempts to provoke.
"The Court finds and concludes that the motion was substantially frivolous, substantially groundless, and substantially vexatious, and therefore lacked substantial justification," Sweat wrote of Smith's motion. - ssn697, on 07/04/2008, -0/+6"At the hearing, Mr. Marshall characterized his response in directing Mr. Smith to leave his office as not the most professional thing to do. I doubt I could have showed that much restraint. I like the very end of the story as well. The judge took it upon himself to send his decision to just about every court, and the state bar. What arrogance to talk to someone like that, and the terrible part is, he is probably a good attorney (many are like that, not all but many) . But his words, questions and attitudes displayed in clear text are just deplorable. A disgusting man to keep bringing up the sons death til it blew up to this. I'm sure he will hear about this from those that enjoy the freedoms Mr Marshalls son sacrificed for.
