Teen avoids prison time in sister's 'Mortal Kombat' death
9news.com — Seventeen-year-old Heather Trujillo was given an 18-year suspended sentence in the death of 7-year-old Zoe Garcia. However, she must spend six years in the youth offender program. If she does not violate the terms of her plea deal, she will not have to spend any time in prison.

I also like how people in that poll who put the blame on only one person put it 7:1 on the black guy even though the white girl participated in beating her 7-year-old SISTER to death.
This pretty much sums up our justice system right here. - LeeSoong, on 07/04/2008, -0/+3She has a great future as a video game tester -
truly dead-icated to winning combo moves.
So if you want to commit a deadly crime:
just act out your best combos,
and claim it's the dead person's fault for dying:
they should have been able to block the combo !

- Hetman, on 07/03/2008, -7/+167This is complete *****. She is just as guilty as her boyfriend if not more. It was her little half sister. This is just more sexism in our justice system. I can guarantee if this was reversed it would be completely different story. The girl friend would have gotten off with probation and the brother would have been sent to jail for life. You have a responsibility to your younger siblings and in my mind she is way more guilty than her boyfriend.
- scooterbaga, on 07/03/2008, -35/+4It's called an ACCIDENT.

Horribly. - Drahkar, on 07/03/2008, -0/+11Dropping someone once is an accident. Repeated body slams, kicks and hits push the whole thing out of the realm of accident relatively quickly.
For example. if I'm cleaning my gun and it goes off once and hits you. That could be an accident. If I'm cleaning my gun and it goes off ten times... Its a little harder to believe thats still an accident.
- Atomic1fire, on 07/03/2008, -10/+16Fataltys are no accident
Capital punishment would come in handy right now- scooterbaga, on 07/03/2008, -14/+2That's odd... so what does involuntary manslaughter mean?
- BoonTobias, on 07/03/2008, -2/+7capital punishments are already pretty handy, just ask our friend sub zero
- thestranger, on 07/03/2008, -1/+4So are you really supporting the idea that she just get thrown into the electric chair? Do you really she deserves to die? Her body left burnt and...TOASTY?
Sorry, man she went through the courts and they decided her punishment. There is no one-button death penalty code in our Justice system. - SimonTB, on 07/03/2008, -5/+4Yes, she does deserve to die. Actually, I'd rather see her in prison for the rest of her life without possibility of parole. That'd be much worse.
- DM01, on 07/04/2008, -0/+6I'd rather just drop them off in some remote region of africa and let them handle theirselves while our tax dollars go to something more important than prisons and pointless judgements.
- Lukesed, on 07/04/2008, -0/+1If life in prison without parole is worse than death, why don't people who earn the former punishment just kill themselves?
- Pake, on 07/03/2008, -1/+24That sad part is just as you say, she's equally responsible, but while she gets a cozy little suspended sentence, watch the boyfriend end up with life in prison all because of his gender and race.
- Hetman, on 07/03/2008, -0/+6I do not believe in Capital punishment and there is such a thing as manslaughter. I am not saying that this is what happened. I am just saying it does happen.
- ileftfark, on 07/03/2008, -0/+29Yeah, but he's *black*. Maybe you didn't catch that part.
/wishing it were sarcasm - Kohaxx, on 07/03/2008, -1/+16As horrible as it is, somehow the fact that the black boyfriend dating a white girl ended up with way more time doesn't surprise considering this is Colorado we're talking about.
- LeeSoong, on 07/04/2008, -1/+7Somehow the fact that the black boyfriend dating a white girl ended up killing a 7 year old little girl is ok then, right ?
Funny, most people manage to grow up with their sisters without getting them killed by boyfriend.
Our justice system needs a new 'punishment' :
"Life Until Death."
The convicted person gets life in prison until they are sick of it, then they can choose to be euthanized via suicide pill overdose whenever they want 'out.'
It is more choice than little Zoe had,
and doesn't involve them being beaten to death.
Both the sister and the boyfriend should be given
the 'Life until Death' sentence.
While they sit in prison, they can think about why it's NOT OK to beat children to death. They can sit and think about that for as long as they want, and 'check out' whenever they feel ready to leave . . . - Kohaxx, on 07/04/2008, -0/+2Oh no I totally agree, if you do the crime you should do the time, it's just bs that the family manages to get her off while sentencing the boyfriend.
- LeeSoong, on 07/04/2008, -1/+7Somehow the fact that the black boyfriend dating a white girl ended up killing a 7 year old little girl is ok then, right ?
- mlwarrior, on 07/04/2008, -8/+5Step 1) Beat little sister to death.
Step 2) Cry and say Mortal Combat made you do it (the one game all adults know) .
Step 3) ?
Step 4) Don't go to jail AT ALL (profit). - judicar, on 07/04/2008, -1/+7Honestly, they both look retarded.

- kansai22, on 07/04/2008, -2/+5Sexism and Racism!!! Both should be given nearly the maximum sentence they were 17 years old. No excuse and for a girl to do that. - sovereign3, on 07/03/2008, -0/+13I know these are different states, but they're very similar situations. Lionel Tate, who is black, received a life sentence for a similar crime in Florida.
http://archives.cnn.com/2001/LAW/03/09/wrestling.s ...
And many wonder why we're skeptical of the justice system?
The prosecutor's rationale was that Tate "knew exactly what he was doing." - LeeSoong, on 07/04/2008, -0/+2They went with the ''Mortal Kombat'' defense

the ''My Little Pony'' defense wouldn't work. - opticwind, on 07/04/2008, -2/+4You know what's funny about generalizing about an entire state when you're outraged about racism? Nothing. You're a hypocrite.
- Zarokima, on 07/03/2008, -0/+131I call ***** on the whole "We were acting out Mortal Kombat" thing. Now, I'm not sure if this is the norm, but everyone I know stopped acting out movies/TV shows/video games/etc. before we were even teenagers. More importantly, they're way past the point of knowing better than to beat up someone ten years younger than them, and even if they were "just playing" they should be able to tell when they're hurting someone, especially bad enough to kill her. Both of them deserve nothing less than the maximum allowed punishment.
- Atomic1fire, on 07/03/2008, -14/+11Capital punishment would sure come in handy right now
Give them a fatalty - Alphabet, on 07/03/2008, -0/+44Have you ever seen those videos of people doing backyard wrestling? They jump off the roof to body slam another person. They hit each other with chairs. They throw each other on tables in order to break it.
seriously, people are ***** retarded.- saltydawkins, on 07/03/2008, -3/+2True dat
- alexforcefive, on 07/03/2008, -5/+2I agree with you, but if someone was jumping off a roof they'd be doing a cross body, not a body slam :D

- bushout, on 07/03/2008, -1/+6Exactly, when I was a kid I pretended I could fly after seeing superman but I was smart enough to do it onto the couch (sorry Dad :)
Actually I still can fly you know... wife rolls eyes. - djholybolt, on 07/04/2008, -0/+11I used to play fight with my brother and my friends and we always knew if we had applying too much pressure or hit too hard.
This sounds like a case of them getting drunk and beating the girl to the point of death.
The story even states that drinking had occured and that family members had noticed bruises on the little girl from previous incidents.
Next thing we'll see is some stupid ass lawyer try and pin midway and Mortal Kombat for the death of the kids and repremand the game from being sold anymore. It's a damn good thing that they're not liable. - gab00n, on 07/04/2008, -0/+6They should have to fight actual ninjas to their death as punishment, elect me as your Dictator and I'll make it happen tomorrow.
- moore, on 07/04/2008, -4/+1Do you really think they intended to murder her? If that's the case I agrtee with a harsh sentence, but stupidity, even extreme stupidity, deserves some degree of excuse in a case like this. Assuming that's what it was.
- Zarokima, on 07/04/2008, -0/+6Stupidity is never an excuse for anything.
- moore, on 07/04/2008, -4/+1Yes, you're a genius, really. The crime of accidentally killing someone in an automobile accident in which you are at fault (stupidity), is the same as planning and carrying out a murder for personal gain. They're the same in every way. You ***** moron.
- Xsecrets, on 07/04/2008, -0/+6There is a difference between an accident and plain stupidity. An automobile accident is usually something like you weren't paying enough attention. The automobile equivalent of this would be hey lets drive my car through that crowd at 60mph cause they do it in the movies. If you are too stupid to understand the consequences of that type of action you need to be locked up to protect the public from your dumb ass.
- moore, on 07/04/2008, -4/+1The likelihood of her repeating this sort of act is negligible because it wasn't intentional. If someone plowed through a crowd of people because they legitimately did not know it was likely to kill or injure people, that would be the same thing. The way you frame it, intentionially driving through a crowd, obviously that is a psychopathic act. Wresting and fighting with siblings is not psychopathic, it's something everybody does. If you must make a car analogy maybe it's closer to running a couple of red lights in a row. Stupid as hell but it's something that happens within a non-psychopathic context, it's going too far, not knowing where to stop. Stupid but not malicious.
- DogHumpsMonkey, on 07/04/2008, -0/+4How do you know it wasn't malicious? How do you know that when that little girl was beat half to death, these two didn't just smile and keep going because it was "fun"? Because they said so? Malice or stupidity, who cares? They need to be punished for what they did. A little girl is dead and you equate that to the same level of criminality as running a couple of red lights? WTF? When you are injuring a child, and continue to do so to the point you cause that child's death, it is nothing less than psychopathic.
- moore, on 07/04/2008, -2/+1You're a moron.

- EatingPie, on 07/03/2008, -14/+22Having sat through a trial, it's incredible how LITTLE we can judge based on newspaper reports, particularly in terms of the reporter's bias (eg "they're guilty, here's testimony that supports that... and I'll leave out opposing testimony).
One thing that moved me was the mother's words "I already lost one daughter... She made a huge mistake and she paid a huge price. My family hasn't had a chance to grieve for Zoe because of all this. We haven't been together, haven't got any time to express how this has affected us."
That's a call for compassion. The punishment should fit the crime. Isn't a lifetime of remorse -- *assuming* she was remorseful (which the mother implies) -- a very strong, and appropriate, punishment?
-Pie- Atomic1fire, on 07/03/2008, -1/+23So?
Another family lost a son
The same family your talking about lost an 7 yearold
where was compassion when the 7 year old got the fatality? - Hetman, on 07/03/2008, -0/+6It was her step sister also. What about her father or mother.
- SimonTB, on 07/03/2008, -1/+14I don't care. Sure it'll suck for the mom, but the daughter deserves a long ass time in prison. Maybe a prison for the criminally insane would be more fitting, as she's 18 and claims to have been acting out a video game.
- facelogic, on 07/03/2008, -5/+4No, it was her half sister...not step sister.
I'm with pie - right on man. - Hetman, on 07/03/2008, -0/+4Well if it was her half sister. Where is her half sisters' mom/dad whatever it may be. Secondly if you agree with Pie Face then do you believe that the boyfriend should have got the same sentence? I mean why ruin his family at all.
- rakous, on 07/04/2008, -0/+3I agree that he should have gone to an insane asylum, yes. There is no way a sane person would do something like that in the name of Mortal Kombat.
- ZenMojo, on 07/04/2008, -0/+1Please, what about compassion for the pretty white girl? ***** the black guy, though, throw him in jail.
- Tyrghast, on 07/04/2008, -0/+2To look at it from a completely non-personal and slightly sadistic point of view, an execution would be cheaper and more efficient than tossing her in prison. People this lacking in sheer common sense will most likely become a drag on society, whether it's spending tax dollars to clothe and feed them in prison or sitting at home collecting a welfare check.
She's an idiot, her boyfriend is an idiot, and neither of them should retain their right to life. They deliberately mistreated a 7-yr old girl (against two 18-yr old kids no little girl stands a chance) with full knowledge and intent to hurt her. They didn't mistreat an animal or cough and give someone a cold, they attacked a child and have therefore forfeited any 'rights'.- opticwind, on 07/04/2008, -0/+1A right is something that can not be taken away. If it's forfeitable, then it's a privilege granted to you.
- moore, on 07/04/2008, -1/+1You're a ***** moron. I hope you do a bad thing one day, maybe make a mistake, and some moronic ***** like you decides that means you "forfeit all right to life" and executes you on the spot. Give you a taste of your own retarded, bloodthirsty philosophy.
- Betrayer, on 07/04/2008, -0/+2"One thing that moved me was the mother's words "I already lost one daughter...""
of course she would say that... wouldnt you feel bad if you tried raising a child and it becomes a murderer... she is saying that to save face!
if the daughter is stupid enough to "accidentally" kill a family member, whos to say she wont make other bad life decisions that will get another person killed.- opticwind, on 07/04/2008, -0/+2Here's an idea, think before you type. Do you have any proof of any of your claims? Her daughter was killed and she has accepted it was her other daughter.

- scooterbaga, on 07/03/2008, -23/+16Jesus... It's like nobody has ever played rough with a kid before! What's wrong with you guys? It's not like they were playing kickball with an infant as the ball. Kids play fight all the time.
I remember once when I was a kid, my older brother and his buddy tossing me 10 feet onto an old mattress and I was having a great time! I suppose they should be in jail right now for abuse or criminal negligence?
Or all the times I got spun around in the air by my ankles... Was that wrong too?
Accidents. *****. Happen.
Even the family of the dead child is against too severe a punishment! That should tell you something.- psevium, on 07/03/2008, -1/+28"Kids" play fight, not ***** 18 year olds who can easily injure a 7 year old. Since when does a 17 year old guy who is more or less an adult in build, slam and throw around a 7 year old?
- Velnich, on 07/03/2008, -3/+5Kids as old as 18 might not be the picture of innocence itself, but they are far, far (so very far far far) from mature adults that always make the correct decisions.
- Kohaxx, on 07/03/2008, -0/+8Yeah but generally they should be able to make the decision not to beat the life out of a little kid. IMO both should have been tried as adults.
- moore, on 07/04/2008, -1/+1Because they were playing, you dumb *****. Yes, things went too far. Yes there was a huge amount of idiocy involved. But unless you think they intended to murder the girl then this whole thing is fundamentally an accident. Result of negligence? Yeah, probably. But they did not intend to kill.
- siszam, on 07/07/2008, -1/+1Velnich, at 18 I was married, had a child, had another on the way, ran my home and cared for my family. No one ever had to tell me not to kill my children. In fact, no one ever had to instruct me on how to act like a sane, responsible adult. Even as a small child I knew that you don't throw people around until death. It's not playing when you are hurting someone and (from what I heard) she begged them to stop.
You're exactly the kind of retard who abuses children and thinks it's alright. You're like those people who give drugs to toddlers then post a video of it on youtube. Please, please don't breed. You're simply too stupid and dangerous.
- AoiTakuma, on 07/03/2008, -1/+7Rough housing with a kid isn't a problem. It is when you don't stop when they are obviously hurt. Being thrown onto a mattress and being twirled around by your ankles are not the same as practicing moves made to do incredible amounts of damage to an adult.
Accidents do happen, but this should have been avoided. And the fact that the little ***** tried to blame it on video games makes it even worse.- Betrayer, on 07/04/2008, -0/+2"And the fact that the little ***** tried to blame it on video games makes it even worse."
most rational people know video games were not the cause of her RETARDATION. - moore, on 07/04/2008, -1/+1Yes, the girl made an error in judgement. An error with very big consequences. But I very much doubt it was malicious to the point that they intended severe injury. They were just stupidly unaware of the harm they were doing. Apparently, hitting and punching a 7 year-old until she falls unconscious and dies is "goofing off." Good to know. The next time my daughter savagely beats her younger brother I'll just say, "Stop goofing off." That'll teach her.- kagebutsu, on 07/03/2008, -0/+30The father sounds like a ***** tool.

WTF....I don't care who you are, nobody aged 17 or 18 should think that body slamming seven year old girls won't kill them. They're either mentally handicapped or insane.- triad203, on 07/06/2008, -0/+2Or worse, they just didn't like the girl and were hurting her on purpose... He is ELECTED. Now, what happens to his job when his opponent says that the DA didn't prosecute a teenage murderer? Or, what if an ADA was in charge (or a state attorney if your state doesn't have the DA/ADA expressions, which some don't), he'd get his ass fired for not taking care of a murder case. You know what, if you don't have enough common sense to think 'oh, she's a 7-year-old little girl and much smaller than we are', then you deserve prison time. She is doing the usual thing of hiding behind a video game. No video game made her beat her sister to death. But as soon as you say that, it's like a magical get-out-of-jail-early card.
- lennybird, on 07/04/2008, -0/+2No, it usually goes - the younger the kid is, the more responsible the adult. 17 may as well be eighteen here in the states. If the crime is serious enough, they will easily try you as an adult. Definitely not just the mother's fault. People too quickly blame the parents (and I'm saying this as a seventeen year old, myself).

- warlokaz2004, on 07/03/2008, -0/+11That 7 year old was used as a punching bag by 2 individuals older and stranger than she was. The judge should be ***** embarrassed to call themselves one. I don't care if the parent says "Wahhh don't take away my other baby" either. They aren't the law, they aren't the best person to judge how to deal with their own murdering kid.- triad203, on 07/06/2008, -0/+2Actually, I think imprisoning all involved is fine. The PARENTS aren't the ***** victims in this case, they were negligent at the very least. Taking away their "other baby" is exactly what should happen. This girl beat her sister to death. What happens when she has a kid of her own?
- jeykB, on 07/04/2008, -2/+0This isnt something I can judge without seeing how exactly they were acting out Mortal Combat. On the one hand, Ive seen play-fighting of young kids including throwing them up in the air and catching them, flipping them, etc which if there was a mess up could harm the kid but usually isnt. yet if there was malice and negligence in the play-fighting then the sentencing should be harsher. If there were no witnesses to it there is enough doubt not to convict the 18yr old girl of murder.
mistakes happen, theres no reason to ruin their life for it. -
