Apparently the Federation, even when faced with the advent of war, continue to disallow the use of a cloaking device. Hell, the Federation's cloaking device was so advanced they could pass through solid matter with the Enterprise D.

When science means theories, it generally means things that are accepted as true. For example: The special and general theories of relativity, the theory of electromagnetism, the Copernican theory of the solar system, the theory of evolution (I hesitate to use that last one, because a lot of anti-science weenies use its name as an argument against it, however it is still a theory which has about as much acceptance within its field as the others do within theirs), etc.

Yeah its probably going to be illegal fairly quickly, and honestly it will be difficult to argue that there isnt much application outside of military and criminal purposes, so it will fall into a "ban it just in case" class.

People don't realize the work that goes in to this, and a cloaking device could add exciting tools to this under appreciated endeavor.

WASHINGTON - A team of American and British researchers has made a Cloak of Invisibility. Well, OK, it's not perfect. Yet. But it's a start, and it did a pretty good job of hiding a copper cylinder.
